Terms of service

Last Updated: 19 October 2026

1. About these terms

Welcome to Muso’s Stuff (Bendigo). These terms explain your responsibilities when using our website and the terms that apply when you purchase from us online. “We”, “us” and “our” mean Muso’s Stuff (Bendigo). Our online store is hosted by Shopify.

Please read these terms together with our Privacy Policy, Shipping Policy and Returns and Refund Policy. Any additional terms for a particular product or service must be made available before you agree to that purchase.

2. Your Australian consumer rights

Nothing in these terms or our other policies excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

Where Australian consumer guarantees apply, products must be of acceptable quality, match their description and be fit for a purpose made known to us in circumstances covered by the law. Services must be provided with due care and skill and meet other applicable consumer guarantees.

For a major failure with goods, you can choose a refund or replacement. You may also be entitled to compensation for reasonably foreseeable loss or damage. For a minor problem, we may provide a repair or another remedy permitted by law. If the problem is not remedied within a reasonable time, further rights may apply. Manufacturer warranties are additional to these rights.

Change-of-mind conditions, original-packaging requirements and voluntary return periods do not limit your statutory rights. If another store policy conflicts with these rights, your statutory rights prevail.

3. Using our website and your account

Please use the website lawfully and provide accurate contact, delivery and payment details. You must be authorised to use the payment method you select. If you are under 18, please involve a parent or guardian in purchases requiring their consent.

Keep your account access details secure and contact us if you suspect unauthorised use. Do not send passwords or full card details by email. Personal information is handled as described in our Privacy Policy.

You must not misuse the website, attempt unauthorised access, introduce malicious software, commit fraud, infringe intellectual property rights, or submit unlawful, threatening or abusive content. We may reasonably restrict access to protect customers, staff or systems, or address a material breach. Where practical, we will explain the reason and give an opportunity to resolve it. Urgent security risks may require immediate action. Restricting website access does not remove your rights concerning existing orders.

4. Product information and availability

We aim to provide accurate descriptions, specifications, images, prices and stock information. Screen settings may affect how colours appear. A variation in screen appearance does not remove your right to receive goods matching their description.

Availability can change as products sell online and in store. If an ordered item is unavailable or materially different from its listing, we will contact you to discuss the issue. We will not substitute a different product without your agreement. If we cannot supply your order, we will refund amounts paid for the unavailable items and any related delivery charges that are no longer applicable.

If you need advice about compatibility, dimensions or suitability, please ask before ordering so we can help you choose.

5. Prices and payment

The currency, applicable taxes, delivery charges and available payment methods are shown on the website and at checkout. Please check the total before paying. Any third-party payment or finance service may have separate terms, eligibility requirements and fees, which you should review.

We may change prices for future purchases. A later price change does not itself change the price of an order already agreed with you. Promotional offers are subject to the conditions disclosed with the offer.

6. Orders, errors and cancellations

Please check your order carefully before submitting it. An automated order email acknowledges receipt of your order; any further acceptance or fulfilment confirmation will be communicated separately.

If there is a genuine pricing or listing error, a stock problem, a payment failure or a reasonable concern about fraud, we will contact you as soon as practical. We will explain the issue and any proposed solution. We will not charge a higher price or make a material change without your agreement. Any cancellation must be consistent with the contract and applicable law. If we cannot lawfully fulfil the order and it is cancelled, we will refund the amounts paid for the cancelled items and applicable delivery charges.

If you would like to change or cancel an order, contact us promptly. We will explain what is possible at its current stage. Your statutory rights remain unaffected.

7. Delivery and Click & Collect

Available delivery and collection options and charges are shown at checkout. Please review our Shipping Policy for further details. Delivery and preparation estimates are guides; if a significant delay arises, we will contact you to discuss the available options. This does not limit any right you have if goods are not supplied within an agreed or reasonable time.

For Click & Collect, select pickup where available and wait for your ready-for-collection notification before travelling to the store. Bring proof of purchase. If pickup is unavailable at checkout, please contact us for help.

If an order is lost, damaged in transit or incorrectly supplied, contact Muso’s Stuff so we can investigate and arrange an appropriate resolution. We may ask for photographs and reasonable assistance with a carrier enquiry. You do not have to resolve a claim with the carrier before exercising rights you have against us.

8. Returns, faults and warranties

Our Returns and Refund Policy describes our voluntary change-of-mind arrangements and how to contact us about a return. These arrangements operate in addition to Australian consumer guarantees.

If a product develops a fault, please contact us with your order details, reasonable proof of purchase and a description of the problem. We will explain the assessment and return arrangements. A statutory claim is not automatically excluded because a manufacturer warranty or voluntary return period has expired, the original packaging is missing, or the item was discounted.

9. Reviews, feedback and website content

Please ensure reviews and other submissions reflect your experience and do not infringe another person’s rights. You retain ownership of content you submit. For content you submit for public display, you give us permission to display it and make reasonable formatting changes for that purpose. We will seek separate permission before using your private correspondence or identifiable customer photographs in advertising.

We may moderate unlawful, abusive, misleading or irrelevant content. We do not require reviews to be positive.

Website material is owned by us or used with permission. You may browse, share links and use material for personal shopping purposes. Other reproduction or commercial use requires permission unless permitted by law.

10. Third-party services and links

Our website may link to independent services or websites. Their own terms and privacy policies may apply. Please review those terms before using them. The presence of a link does not itself mean we endorse the external website. This does not remove any responsibility we have for products or services we supply or representations we make.

11. Website availability and responsibility

We aim to keep the website available and accurate, but maintenance, technical faults or events outside our reasonable control may interrupt access. We will take reasonable steps to address problems within our control and communicate material impacts on existing orders.

Our responsibility for loss or damage is determined by applicable law. These terms do not exclude liability that cannot lawfully be excluded, including liability under consumer guarantees. You are not required by these terms to indemnify us for our own negligence or wrongdoing.

12. Changes to these terms

We may update these terms for future website use and purchases by publishing a revised version with an updated date. Changes will not retrospectively alter an existing order or remove rights you already have. If a change affects an ongoing arrangement, we will provide any notice and obtain any agreement required by law.

13. Resolving concerns and applicable law

If you have a concern, please contact us with the relevant order details and the outcome you are seeking. We will review the matter and explain our response. You may also seek help from Consumer Affairs Victoria or another relevant consumer protection body, or pursue other remedies available to you.

These terms are governed by the laws of Victoria and applicable Commonwealth laws. This does not restrict mandatory consumer protections or your right to approach a court or tribunal available to you under applicable law. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.
